Human Dignity as a Limit to the Full Automation of Administrative Procedure

Abstract

The article examines formal provisions of administrative procedural law whose automation through language-processing algorithms could be technologically feasible. The central question is whether there are fundamental constitutional objections to such an undertaking, particularly in light of the principle of human dignity. To this end, the administrative procedure, especially its communicative and argumentative procedural steps, is first analyzed in terms of its human rights dimensions. Subsequently, the article explores the extent to which these dimensions can be adequately addressed by language-processing algorithms within a fully automated administrative procedure.
